Canada Essure Litigation Update
Howie, Sacks & Henry LLP (HSH) has been retained by approximately 86 clients so far. We continue to receive inquiries on a weekly basis and expect a further 10 to 20 clients. We have drafted about half of the statements of claims which will be issued by courts across Canada (with the exception of Quebec) in the coming weeks. The balance of the claims will be finalized and issued as soon as the required medical records are received. We will advise you by email when your claim has been issued.
U.S. Essure Litigation Update
The First Essure jury trials, previously scheduled to begin in mid-February, have been postponed and are now expected to begin sometime in the fall in California. We will keep you posted as further information becomes available.
Anticipated Timelines
In the United States there are approximately 30,000 cases nationwide. Approximately 27,000 of those cases have been commenced in California. We have partnered with a U.S. firm that is heading up the litigation in California. We anticipate a number of jury decisions in California by the end of this year. The results of these cases will set the tone for ongoing litigation and potential settlement discussions both in the U.S. and Canada.
We estimate that the Canadian cases will take approximately 3 to 6 years to reach settlement or proceed to trial. However, settlement discussions in Canada will likely follow or be conducted at the same time as the U.S. cases.
