Accident Benefits Forms

New Statutory Accident Benefits Schedule (SABS): Summary and Accident Benefits Forms

All automobile policies in Ontario include statutory accident benefits coverage (SABS) that you are entitled to even if the accident was your fault.

Even with these rights, the process of completing your claim is usually more complex than you think.

Financial Services Commission of Ontario (FSCO)

NOTE:  Effective April 1, 2016, FSCO will no longer adjudicate new accident benefits disputes. FSCO’s Dispute Resolution Service (DRS) will be eliminated and accident benefits disputes will now be adjudicated by the LAT (see above).

NEW Automobile Accident Benefits Service (AABS)

The AABS helps people who are injured by a motor vehicle accident, and have had their claim denied by an insurance company. Drivers, passengers, pedestrians or family members of a person who is injured or dies may all have a claim.

If you can’t agree with the insurance company about whether or not you are entitled to a benefit or the amount of a benefit, you can  apply to AABS for help in solving your dispute. AABS works with individuals and insurance companies to help them quickly reach a settlement.

Effective April 1, 2016, a new branch of Ontario’s Licence Appeal Tribunal (LAT) will begin accepting applications to the new Auto Accident Benefits Service (AABS) system that aims to quickly resolve disagreements between individuals and insurance companies about accident benefits.

The goal of the AABS is to reach a final decision within six months.  It can be a daunting process, so you may wish to work with lawyer to help resolve your dispute.
